2. Daten, die für die Bereitstellung der Website und die Erstellung der Protokolldateien verarbeitet werden
a. Bei jedem Zugriff auf Inhalte der Website werden vorübergehend Daten gespeichert, die möglicherweise eine Identifizierung zulassen. Die folgenden Daten werden hierbei erhoben:

- Datum und Uhrzeit des Zugriffs
- IP-Adresse
- Hostname des zugreifenden Rechners
- Website, von der aus die Website aufgerufen wurde
- Websites, die über die Website aufgerufen werden
- Besuchte Seite auf unserer Website
- Meldung, ob der Abruf erfolgreich war
- Übertragene Datenmenge
- Informationen über den Browsertyp und die verwendete Version
- Betriebssystem

Die vorübergehende Speicherung der Daten ist für den Ablauf eines Websitebesuchs erforderlich, um eine Auslieferung der Website zu ermöglichen. Eine weitere Speicherung in Protokolldateien erfolgt, um die Funktionsfähigkeit der Website und die Sicherheit der informationstechnischen Systeme sicherzustellen. In diesen Zwecken liegt auch unser berechtigtes Interesse an der Datenverarbeitung.

b. Die Daten werden auf der Grundlage des Art. 6 Abs. 1 Buchstabe f DS-GVO verarbeitet.

c. Die Website wird bei Host Europe GmbH, c/o WeWork, Friesenplatz 4, 50672 Köln gehostet. Der Hoster empfängt die oben genannten Daten als Auftragsverarbeiter.

d. Die Daten werden gelöscht, sobald sie für die Erreichung des Zwecks ihrer Erhebung nicht mehr erforderlich sind. Bei der Bereitstellung der Website ist dies der Fall, wenn die jeweilige Sitzung beendet ist. Die Protokolldateien werden maximal bis zu 24 Stunden und ausschließlich für Administratoren zugänglich aufbewahrt. Danach sind sie nur noch indirekt über die Rekonstruktion von Sicherungsbändern verfügbar und werden nach maximal vier Wochen endgültig gelöscht.

3. Betroffenenrechte

a. Recht auf Auskunft
Sie können Auskunft nach Art. 15 DS-GVO über Ihre personenbezogenen Daten verlangen, die wir verarbeiten.

b. Recht auf Widerspruch:
Sie haben ein Recht auf Widerspruch aus besonderen Gründen (siehe unter Punkt II).
c. Recht auf Berichtigung
Sollten die Sie betreffenden Angaben nicht (mehr) zutreffend sein, können Sie nach Art. 16 DS-GVO eine Berichtigung verlangen. Sollten Ihre Daten unvollständig sein, können Sie eine Vervollständigung verlangen.

d. Recht auf Löschung
Sie können nach Art. 17 DS-GVO die Löschung Ihrer personenbezogenen Daten verlangen.

e. Recht auf Einschränkung der Verarbeitung
Sie haben nach Art. 18 DS-GVO das Recht, eine Einschränkung der Verarbeitung Ihrer personenbezogenen Daten zu verlangen.

f. Recht auf Beschwerde
Wenn Sie der Ansicht sind, dass die Verarbeitung Ihrer personenbezogenen Daten gegen Datenschutzrecht verstößt, haben Sie nach Ar. 77 Abs. 1 DS-GVO das Recht, sich bei einer Datenschutzaufsichtsbehörde eigener Wahl zu beschweren. g. Recht auf Datenübertragbarkeit
Für den Fall, dass die Voraussetzungen des Art. 20 Abs. 1 DS-GVO vorliegen, steht Ihnen das Recht zu, sich Daten, die wir auf Grundlage Ihrer Einwilligung oder in Erfüllung eines Vertrags automatisiert verarbeiten, an sich oder an Dritte aushändigen zu lassen. Die Erfassung der Daten zur Bereitstellung der Website und die Speicherung der Protokolldateien sind für den Betrieb der Internetseite zwingend erforderlich. Sie beruhen daher nicht auf einer Einwilligung nach Art. 6 Abs. 1 Buchstabe a DS-GVO oder auf einem Vertrag nach Art. 6 Abs. 1 Buchstabe b DS-GVO, sondern sind nach Art. 6 Abs. 1 Buchstabe f DS-GVO gerechtfertigt. Die Voraussetzungen des Art. 20 Abs. 1 DS-GVO sind demnach insoweit nicht erfüllt.

II. Recht auf Widerspruch gemäß Art. 21 Abs. 1 DS-GVO
Sie haben das Recht, aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit gegen die Verarbeitung Ihrer personenbezogenen Daten, die aufgrund von Artikel 6 Abs. 1 Buchstabe f DS-GVO erfolgt, Widerspruch einzulegen. Der Verantwortliche verarbeitet die personenbezogenen Daten dann nicht mehr, es sei denn, er kann zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die die Interessen, Rechte und Freiheiten der betroffenen Person überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen. Die Erfassung der Daten zur Bereitstellung der Website und die Speicherung der Protokolldateien sind für den Betrieb der Internetseite zwingend erforderlich.

Die folgenden Allgemeinen Geschäftsbedingungen gelten weltweit, insbesondere für den Vertrieb im Apple App Store. Sie sind deshalb auf English verfasst.

Terms of Service

For the IOs-Version of flixGrade applies:

Apps made available through the App Store are licensed, not sold, to you. Your license to each App is subject to your prior acceptance of either this Licensed Application End User License Agreement (“Standard EULA”), or a custom end user license agreement between you and the Application Provider (“Custom EULA”), if one is provided. Your license to any Apple App under this Standard EULA or Custom EULA is granted by Apple, and your license to any Third Party App under this Standard EULA or Custom EULA is granted by the Application Provider of that Third Party App. Any App that is subject to this Standard EULA is referred to herein as the “Licensed Application.” The Application Provider or Apple as applicable (“Licensor”) reserves all rights in and to the Licensed Application not expressly granted to you under this Standard EULA.

a. Scope of License: Licensor grants to you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules. The terms of this Standard EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Licensor that replace or supplement the original Licensed Application, unless such upgrade is accompanied by a Custom EULA. Except as provided in the Usage Rules, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the Licensed Application and, if you sell your Apple Device to a third party, you must remove the Licensed Application from the Apple Device before doing so. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Licensed Application).

b. Consent to Use of Data: You agree that Licensor may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

c. Termination. This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.

d. External Services. The Licensed Application may enable access to Licensor’s and/or third-party services and websites (collectively and individually, "External Services"). You agree to use the External Services at your sole risk. Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to financial, medical and location information, is for general informational purposes only and is not guaranteed by Licensor or its agents. You will not use the External Services in any manner that is inconsistent with the terms of this Standard EULA or that infringes the intellectual property rights of Licensor or any third party. You agree not to use the External Services to harass, abuse, stalk, threaten or defame any person or entity, and that Licensor is not responsible for any such use. External Services may not be available in all languages or in your Home Country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws. Licensor reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice or liability to you.

e. NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

f. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Licensor’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

g. You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.

h. The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.
i. Except to the extent expressly provided in the following paragraph, this Agreement and the relationship between you and Apple shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Apple agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from this Agreement. If (a) you are not a U.S. citizen; (b) you do not reside in the U.S.; (c) you are not accessing the Service from the U.S.; and (d) you are a citizen of one of the countries identified below, you hereby agree that any dispute or claim arising from this Agreement shall be governed by the applicable law set forth below, without regard to any conflict of law provisions, and you hereby irrevocably submit to the non-exclusive jurisdiction of the courts located in the state, province or country identified below whose law governs:
If you are a citizen of any European Union country or Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
Specifically excluded from application to this Agreement is that law known as the United Nations Convention on the International Sale of Goods.

Additional Agreements

1. Acknowledgement
Please note that these Terms are between us and you, not Apple. We are solely responsible for the flixGrade App and any content produced on it. If there are any conflicts between these Terms and the Apple Store Terms of Service, the Apple Store Terms of Service will apply.
2. Scope of Licence
The licence granted to you in these Terms to use the flixGrade App is for use on Apple-branded products, owned or controlled by you. The flixGrade App may be used or accessed by other accounts associated with you via Family Sharing or volume purchasing. We’re giving you personally the right to use the flixGrade App as set out above. You can’t transfer the flixGrade App or the Service to someone else, whether for money, for anything else or for free. And if you sell any device on which the flixGrade App is installed, you must remove the flixGrade App first. You must also keep all passwords secure and not provide this information to anyone else. Mitarbeitsapp GmbH hereby grants you a personal, non-transferable, non-exclusive licence to use the flixGrade App software on your devices in accordance with the terms of this EULA agreement. You are permitted to load the flixGrade App software (for example a mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the flixGrade App software. By using the App you take note of and permit that your use of functions within the app is monitored and statistically analysed.
You are not permitted to:
* Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things Reproduce, copy, distribute, resell or otherwise use the Software for any commercial purpose.
* Allow any third party to use the Software on behalf of or for the benefit of any third party.
* Use the Software in any way which breaches any applicable local, national or international law use the Software for any purpose that Mitarbeitsapp GmbH considers is a breach of this EULA agreement.
3. Maintenance and Support
If you need any support with respect to the flixGrade App, please contact us, not Apple as they are under no obligation to help with any support or maintenance questions arising out of use of the flixGrade App.
4. Warranty
In the event of any failure of the flixGrade App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the flixGrade App to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the flixGrade App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility. To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our App and the use of flixGrade App. In particular for data breaches and losses or damage of any kind that might result from it.
5. Product Claims
We are responsible for addressing any claims from you or any third party relating to the App or the end- user’s possession and/or use of the flixGrade App, including, but not
limited to:
(i) product liability claims; (ii) any claim that the flixGrade App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with flixGrade’s use of the HealthKit and HomeKit frameworks. Again, to the maximum extent permitted by applicable law, we exclude all product claims.
6. Intellectual Property
In the event of any third party claim that the flixGrade App or your possession and use of the the flixGrade App infringes that third party’s intellectual property rights, the Mitarbeitsapp GmbH App, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim. Mitarbeitsapp GmbH shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of Mitarbeitsapp GmbH.
7. Legal Compliance
You represent and warrant that
(i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and
(ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Applicable law and place of jurisdiction
Applicable law ist the law of the federal republic of germany. The place of jurisdiction is Hannover in Lower saxony, Germany
10. Third Party Terms of Agreement
You must comply with applicable third party terms of agreement when using the flixGrade App.
11. Third Party Beneficiary
Apple, and Apple’s subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

For the Android Version the same applies analogous.
In addition to the Terms of Service from the "Google play store" Mitarbeitsapp GmbH GmbH will not be responsible for any damages, that may arise from the use of the flixGrade App. Again valid is: TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
